How to Request a Hearing

A person or entity may request an administrative hearing pursuant to Cincinnati Municipal Code Section 1501-17.  However, it must be within the time limits prescribed by Cincinnati Municipal Code Section 1501-15(a).  Hearing examiners may decline to hear a case if the request is untimely.

These hearings usually occur via Zoom conference, telephone conference, or in-person at 805 Central Avenue, Suite 110, Cincinnati, Ohio, 45202.  In some cases, the accused person or entity may admit the violation and request a "cure credit" without the need for a formal hearing.

How to Appeal an OAH Decision

Final decisions of the Office of Administrative Hearings can be appealed to the Hamilton County Court of Common Pleas pursuant to Ohio Revised Code Section 2505.03 and Cincinnati Municipal Code Section 1501-25.  The Court may decline to review an OAH decision if the appeal is untimely.

These appeals are filed at the Common Pleas Civil Desk in the Hamilton County Courthouse, Room 315, 1000 Main Street, Cincinnati, Ohio 45202.  Please serve notice of your appeal to the Office of Administrative Hearings, 805 Central Avenue, Suite 110, Cincinnati, OH 45202.

The Hamilton County Court of Common Pleas Clerk may require an additional fee to file an appeal.

 

Administrative Hearing Fees

The Office of Administrative Hearings is permitted to assess an administrative hearing fee pursuant to Cincinnati Municipal Code Section 1501-35.  This additional fee varies from $25 for a "PSC" hearing to $75 for a "B&I" hearing.  No fee will be assessed if the case is dismissed.  The fee can also be waived in the case of indigency or where justice otherwise requires.
