ADA Requirements
Accessible Routing
Business intending to expand onto the the public right-of-way (public sidewalk or street) will need to develop plan that ensures all Americans with Disabilities Act (ADA) requirements.
Permit holders, expanding outdoor dining seating onto the public ROW will be required to maintain a continuous accessible route of travel for individuals who use wheelchairs or walking aids or who walk with difficulty, in congruence with the ADA. Permission for outdoor street dining in the right-of-way shall be conditioned on maintenance of accessible conditions along the sidewalk adjacent to the outdoor dining area.
This single continuous path should:
- A minimum path of travel along the sidewalk area of at least 48 inches in width at all points adjacent to the outdoor dining area, which area shall be permitted to be narrowed due to existing sidewalk fixtures (e.g., light posts, fire hydrants, and other fixtures) but in no case shall be narrower than 36 inches for a length of more than 2 feet.
- Along the route, slopes no more than 1:20 unless a ramp with handrails and edge protection is installed. Ramps are limited to a slope of 1:12. All cross slopes are limited to 1:48.
- The accessible route is free of any hazardous, protruding objects.
- Be smooth, but not slippery.
- Be as level and as wide as possible without low or overhanging hazards or obstructions. Level changes greater than 1/2 inch, such as a step, stairway, or full floor level, have a ramp, lift, or elevator.
- Not require the use of stairs.
- If accessible routing deviates from general pathways, it is identified with directional signage.
