3/31/2009, We move that the
administration:
Recommend changes in the City's building codes
and
administrative procedures that would allow implementation of
the three-tiered
approach to setting clear, workable and
protective
standards that define rental property owners' duties
outlined
in the Lead-Safe Housing Policy Guidance from the
Alliance for Healthy Homes;
Recommend an evaluation process for
the
Cincinnati Health Department's lead program and any other
lead-related
programs for the City. The evaluation should
include
an assessment of the programs and its management, and
recommend
improvements that include methods for measuring and
tracking
progress, setting priorities and building in
accountability.
The administration shall provide estimates for a
consultant
to conduct the evaluation; e.g., the Coalition to End
Childhood
Poisoning. Review other municipal ordinances that
require
mandatory lead certificate/licensing and inspection,
including
Rochester, NY, Washington, D.C. and Chicago, including
a
review of criteria for mandatory rental certification and
develop
legislation that incorporates the most effective
elements
of those ordinances; Recommend legislation that gives
the
city right of entry and inspection of properties where lead
is
present, similar to Chicago's program; uses the City's
administrative
hearing process for enforcement of violations,
emphasizing
civil citations; add pre-prosecution meetings as an
option
to resolve violations; and includes civil remedies,
including
allowing City Buildings and Inspections to issue
citations
