MOTION, dated 9/26/2007 submitted by Councilmember Berding, I MOVE that the jurisdiction of the Subcommittee on Transportation and Engineering be established as: The Interstate 75 corridor, related infrastructure and utilities, and the Mill Creek. The work of the Subcommittee as it relates to I-75 shall inform the City's other transportation and infrastructure projects and provide a model for integrated departmental planning, design standard setting and community participation.

MEMO, dated 6-26-27, submitted by Councilmember Chris Bortz from Milton Dohoney Jr., City Manager, PUBLIC AND PRIVATE ELEMENTS IN THE SIDEWALK SPACE UPDATE The initial report on public and private elements such as advertising benches, news racks, bus stop shelters, and temporary signs and facilities located in the sidewalk space, was issued to City Council on March 28, 2007 (Document #200700363). Since then, work has continued on topics to be covered in the second report on this issue. The second report will provide best practices of other cities, discuss legal issues related to those uses of the right-of-way, identify alternatives, and provide guideline recommendations. Administration is working closely with Downtown Cincinnati Incorporated (DCI) to seek input and develop recommendations, especially regarding newspaper racks in downtown.

MOTION, dated 03/07/2007, submitted by Councilmember Cranley, that the proposed lease with Queensgate for the City land formerly owned by Hilltop Concrete Company be rejected; and that this land be designated for greenspace and recreation; and that the City begin planning to convert this land into a park (understanding that some of this land will be needed for remodeling the Waldvogel viaduct); and that the City report back to City Council in 6 months on how the City might secure and operate a bike/running trail from the Hilltop property down the Western Riverfront to the Conrail site and beyond. MOTION, dated 4/2/2007 submitted by Councilmembers Bortz, Ghiz and Berding that appropriate notice be sent to Bench Billboard Co. on the 722 advertising benches previously authorized under Ordinance 187-1996, informing the company that the benches are no longer authorized and must be removed immediately. WE FURTHER MOVE that appropriate notice be given to revoke the permits of the remaining advertising benches currently authorized under CMC Section 723-20.

MOTION, dated 6/19/2007 submitted by Councilmember Monzel, that any proposed lease with Queengate for the city land formerly owned by Hilltop Concrete Company be rejected. I further move that this land be designated as greenspace and used for recreational purposes. MOTION, dated 01/14/2008, submitted by Vice-Mayor Crowley and Councilmembers Thomas, Berding, Cranley, Bortz, Qualls and Cole that the proposed increases in fare for the Metro Access service be separated from the Ordinance authorizing a general fare increase until the need for the increase for access services is re-evaluated by the Metro Board and presented to the Finance Committee for action.

ORDINANCE (EMERGENCY) submitted by Milton Dohoney, Jr., City Manager, on 1/9/2008, approving and authorizing execution of a "Property Investment Reimbursement Agreement" with Kendle International Inc. (the "Employer") in which the Employer agrees to lease nine floors in the Carew Tower which will serve as the Employer's corporate headquarters at 1200 Carew Tower, 441 Vine Street, Cincinnati, and to create and retain new jobs, and the City agrees to provide funding for the project of up to $204,750 over a 5-year period with annual payments limited to up to 50 percent of new income tax revenues from new jobs created by the Employer.

ORDINANCE submitted by Milton Dohoney, Jr., City Manager, on 1/9/2008, authorizing the payment of $350,000.00 as a moral obligation to The Port of Greater Cincinnati Development Authority, an Ohio non-profit corporation, in consideration for its provision of professional services, outside of the proper contracting procedures, in connection with economic development activities throughout greater Cincinnati.

ORDINANCE (EMERGENCY), submitted by Milton Dohoney, Jr., City Manager, on 1/14/2008, Authorizing the City Manager to enter into an agreement with the National Underground Railroad Freedom Center ("Freedom Center") and the Board of County Commissioners of Hamilton County, Ohio ("County") with respect to Lot 7 of the Central Riverfront real estate, commonly know as the "Banks".

ORDINANCE (EMERGENCY), submitted by Milton Dohoney, Jr., City manager, on 1/14/2008, Establishing the Banks Development Phase I capital improvement program project account (980x232x03490) within the Department of Transportation of Engineering, and further Authorizing the transfer of the sum of Five Hundred Thousand Dollars ($500,000) from the unappropriated surplus of Permanent Improvement Fund 758 to new Banks Development Phase I capital improvement program project account 980x232x03490 for the purpose of providing funds for expenses related to Phase I Banks development.

ORDINANCE (EMERGENCY), submitted by Milton Dohoney, Jr., City Manager, on 1/14/2008, Amending Ordinance 421-2002 passed on December 18, 2002 and Ordinance 249-2007 passed June 20, 2007 to remove certain real property from the District 11-Evanston District Incentive District, and declaring an emergency.

ORDINANCE (EMERGENCY), submitted by Milton Dohoney, Jr., City Manager, on 1/14/2008, Declaring to be a public purpose certain improvements to parcels of real property in the City of Cincinnati which are necessary for the further development of the Keystone Parke Project, describing the public infrastructure improvements to be made to directly benefit the respective parcels, and declaring an emergency.

ORDINANCE (EMERGENCY), submitted by Milton Dohoney, Jr., City Manager, on 1/14/2008, Repealing Ordinance 302-2007 and Providing for the issuance, sale and delivery of not to exceed $4,200,000 of Economic Development Bonds (The Keystone Project) or notes in anticipation thereof, of the City of Cincinnati, County of Hamilton, State of Ohio, for the purpose of financing certain improvements; authorizing a pledge of the City's faith and credit or a pledge of and lien on certain revenues an other city resources, as appropriate, to secure such bonds or notes; and authorizing necessary documents to secure such bonds or notes.

ORDINANCE, submitted by Councilmember Y. Laketa Cole, from J. Rita McNeil, City Solicitor, Amending Ordinance No. 119-2007, which regulates Community Reinvestment Area exemptions, in order to provide that the minimum cost of improvements necessary to trigger eligibility for a commercial or industrial tax exemption by a qualifying small business shall be reduced from $100,000.00 to the amount of $40,000.00.

REPORT, (SUPPLEMENTAL) dated 9/6/2007 submitted by Milton Dohoney, Jr., City Manager on a motion dated 9/25/2006 submitted by Councilmember Cole, that the following provisions of Ordinance 342-2002 be amended: 1. The provisions that apply to commercial or industrial structures shall be amended so that any renovation or new construction of a commercial or industrial property that is to be occupied by a small business be exempt from the requirement that their tax abatement application be approved by City Council. 2. For a small business, lower the minimum cost of improvements necessary to trigger eligibility for a commercial or industrial tax exemption from $100,000 to an amount deemed appropriate by the administration that would enable the majority of small businesses in Cincinnati to participate in this program. However, that amount must not be lower than $5000. I FURTHER MOVE that for the purpose of this motion, small business shall be defined using the current federal Small Business Administration Guidelines that are currently used by the City of Cincinnati's Small Business Division. I FURTHER MOVE that the Law Department investigate the legality of developing a single ordinance that would pertain to all Community Reinvestment Area tax abatements given to small businesses. I FURTHER MOVE that the administration develop a tax abatement application for small business similar to the current tax abatement application for residential renovation and construction; as well as a model third-party agreement contract to ensure that a small business that leases property and makes improvements to that property will also be able to benefit from this program. McMurphy's liquor license renewal in the years of 2006-2007 and 2007-2008 and with the absence of issues that may have existed in 2005, we are directing the City Administration in the form of the City Solicitor to inform the appropriate Ohio State agencies, including the Ohio Department of Liquor Control and the State Liquor Commission that the City of Cincinnati supports R.P.
