ORDINANCE, submitted by Mayor Mallory NOTWITHSTANDING the provisions of Chapter 1411, 1427 and 1435 of the Cincinnati Zoning Code, the Director of Buildings and Inspections is authorized to issue any and all necessary permits for the installation of murals and/or signage by ArtWorks for the MuralWorks program on walls of a building or structure without a building permit, Certificate of Compliance, or Certificate of Appropriateness for any project through December 31, 2008.

MOTION, dated 9/4/2007 submitted by Councilmember Berding, that the Administration investigate and provide Council with recommendations on how Chapter 761 of the Cincinnati Municipal Code (Chronic Nuisance Premises) can be expanded to include single family dwellings.

MOTION, 9/6/2007 submitted by Councilmembers Berding, Cole, Bortz, Cranley and Qualls that a subcommittee on Transportation and Infrastructure be established as a joint subcommittee of the Finance, Economic Development and Vibrant Neighborhoods Committees. ORDINANCE, (EMERGENCY) submitted by Councilmember Bortz, AUTHORIZING the City Manager to accept $1,900,000.00 from the Otto Armleder Memorial Trust for a new family aquatic center to be located in the Avondale community; approving and designating the name of the aquatic center as "The Otto Armleder Memorial Family Aquatic Center"; authorizing the City Manager to execute the Restrictive Covenant for The Otto Armleder Memorial Family Aquatic Center; and further authorizing the City Manager to enter into a Disbursement Agreement for The Otto Armleder Memorial Family Aquatic Center.

ORDINANCE, (EMERGENCY) submitted by Councilmember Bortz AUTHORIZING the City Manager to execute a Permission to Enter/Indemnification permitting Cincinnati Arts Association to enter onto the Music Hall property and do all things necessary to effect the installation of the Mighty Wurlitizer Organ, formerly housed in the downtown Albee Theatre, in the Music Hall Ballroom, at no cost to the City.

MOTION, dated 9/6/2007 submitted by Councilmembers Cole, Ghiz, Berding, Monzel, Bortz, Cranley and Vice Mayor Crowley that in accordance with Administrative Regulation #8 and the City Solicitor's opinion interpreting this section, that the Department of Health submit an ordinance to Council in order to accept the Ohio Commission on Minority Health Grant. WE FURTHER MOVE that the Health Department immediately return any and all funds received (per Dr. Maseru's email which stated the Department had already received "planning" dollars), until such ordinance is submitted and approved by Council. WE FURTHER MOVE that Administrative Regulation #8 be amended to clearly state that "where any matching fund is a condition for the awarding of a grant, that it be a requirement that such department submit an ordinance to Council for approval prior to applying for said grant.

ORDINANCE, (EMERGENCY) submitted by Councilmember Cranley, AUTHORIZING the implementation of the June 2007 to June 2010 labor management agreement between the City of Cincinnati and the International Association of Firefighters, Local 48, and further, authorizing the City Manager to execute the terms of the new three-year labor management agreement, which is reflected in the tentative agreements attached hereto.

ORDINANCE (EMERGENCY) submitted by Milton Dohoney, Jr., City Manager, on 9/6/2007, authorizing the Public Recreation Commission of the City of Cincinnati to apply for and accept a grant of approximately $3,200.00 from the Ohio Arts Council (OAC) for the purpose of providing funds for the resident artist's fee for a project in narrative quilt making with an OAC Arts Learning Program Residency Artist.

ORDINANCE (EMERGENCY) submitted by Milton Dohoney, Jr., City Manager, on 9/6/2007, authorizing the transfer and appropriation of the sum of $306,060.00 from the unappropriated surplue of General Fund 050 to the "Judgments Against the City" account (050x941x7400), for the purpose of satisfying legal obligations currently owned by the City of Cincinnati in a timely manner.

REPORT, dated 9/6/2007 submitted by Milton Dohoney, Jr., City Manager on a motion dated 9/25/2006 submitted by Councilmember Cole, that the following provisions of Ordinance 342-2002 be amended: 1. The provisions that apply to commercial or industrial structures shall be amended so that any renovation or new construction of a commercial or industrial property that is to be occupied by a small business be exempt from the requirement that their tax abatement application be approved by City Council. 2. For a small business, lower the minimum cost of improvements necessary to trigger eligibility for a commercial or industrial tax exemption from $100,000 to an amount deemed appropriate by the administration that would enable the majority of small businesses in Cincinnati to participate in this program. However, that amount must not be lower than $5000. I FURTHER MOVE that for the purpose of this motion, small business shall be defined using the current federal Small Business Administration Guidelines that are currently used by the City of Cincinnati's Small Business Division. I FURTHER MOVE that the Law Department investigate the legality of developing a single ordinance that would pertain to all Community Reinvestment Area tax abatements given to small businesses. I FURTHER MOVE that the administration develop a tax abatement application for small business similar to the current tax abatement application for residential renovation and construction; as well as a model third-party agreement contract to ensure that a small business that leases property and makes improvements to that property will also be able to benefit from this program. MOTION, dated 09/04/2007, submitted by Councilmember Monzel, that the administration development and implement a plan and/or procedure to deal with the increasing problem of bedbug infestation in our city. This plan should include the establishment of a special "hotline" that citizens can call to have bedbug-infested furniture picked up and removed from their address. The Administration should also evaluate whether the current municipal code effectively deals with bedbug infestations and offer ways to strengthen it. (STATEMENT ATTACHED)
