APPOINTMENT, dated 12/11/2006, submitted by Mayor Mallory, recommending the appointment of Ms. Roxanne Qualls to the Southwest Ohio Regional Transit Authority Board of Directors (SORTA). Ms. Qualls will fill the vacancy created by the resignation of Timothy Williams. Ms Qualls served as Mayor until 1999 and is committed to revitalization of the City of Cincinnati. Ms. Qualls will serve a three-year term that ends on January 1, 2010.

APPOINTMENT, dated 12/8/2006, submitted by Mayor Mallory, recommending the appointment of Michelle Story-Stewart to the Community Reinvestment Act Oversight Committee. Ms. Story-Stewart is a Program Officer for Local Initiatives Support Corporation. Ms. Story-Stewart will serve the remaining term of a vacant position as a Community Member that ends on May 1, 2008.

APPOINTMENT, dated 12/8/2006, submitted by Mayor Mallory, recommending the appointment of James B. Robinson to the Civil Service Commission. Mr. Robinson is a Sole Practitioner concentrating in labor and employment law and mediation. Mr. Robinson will fill the vacancy created by the resignation of Mr. Dan Radford. Mr. Robinson will serve a six-year term that ends on December 31, 2012.

APPOINTMENT, dated 12/11/2006, submitted by Mayor Mallory, recommending the appointment of Mr. Ozie Davis to the Citizens Complaint Authority (CCA). Mr. Davis is the Program Manager for Local Initiatives Support Corporation. Mr. Davis will fill the vacancy created by the expired term of Ms. Martha Camille Anderson Haamid. Mr. Davis will serve a two-year term that ends on January 1, 2009.

APPOINTMENT, dated 12/11/2006, submitted by Mayor Mallory, recommending the appointment of Ms. Kristen Meyers to the Citizen Complaint Authority. Ms. Meyers is an Associate at Beckman Weil Shepardson LLC. Ms. Meyers will fill the vacancy created by the expired term of Mr. Richard D. Siegel. Ms. Meyers will serve a two-year term that ends on January 1, 2009.

APPOINTMENT, dated 12/11/2006, submitted by Mayor Mallory, recommending the appointment of Mr. John S. Fronduti to the Citizens Complaint Authority. Mr. Fronduti is a Partner at Keating Muething & Klekamp PLL. Mr. Fronduti will fill the vacancy created by the expired term of Mr. Walter Bowers II. Mr. Fronduti will serve a two-year term that ends on January 1, 2009.

APPOINTMENT, dated 12/12/2006, submitted by Mayor Mallory, subject to the consent of Council, I hereby appoint Mr. Robert Anning to serve as Commissioner of the Cincinnati Park Board. Mr. Anning has a long history of community service and has been an active member of the Cincinnati Parks Foundation since 1995. Mr Anning will replace the vacancy created by the expired term of Mr. Frank Russell, which will occur on December 31, 2006. Mr. Anning will serve a term that will begin January 1, 2007 and expire on December 31, 2012.

APPOINTMENT, dated 12/11/2006, submitted by Mayor Mallory, recommending the appointment of Francis Penrose Russell to the Board of the Zoological Society. Mr. Russell is a Commissioner on the Cincinnati Park Board and Director of the Community Design Center at the University of Cincinnati. Mr. Russell will fill the vacancy created by the expired term of John Taylor. Mr. Russell will serve a three-year term that ends on December 31, 2009.

APPOINTMENT, dated 12/8/2006, submitted by Mayor Mallory recommending the appointment of Dr. Richard M. Ruddy to the Board of Health. Dr. Ruddy is Professor of Clinical Pediatrics for the University of Cincinnati College of Medicine. Dr. Ruddy will fill the vacancy created by the expired term of Mr. Steven Baines that expired December 1, 2006. Dr. Ruddy will serve a three year term that ends on December 31, 2009.

APPOINTMENT, dated 12/18/2006, submitted by Mayor Mallory pursuant to City of Cincinnati Ordinance No. 369-1998, I am recommending that Councilmember David Crowley serve as the City of Cincinnati representative for the Hamilton County Transportation Improvement District. Councilmember Crowley will replace Councilman Jeff Berding and serve a two-year term that ends on December 31, 2008.

APPOINTMENT, dated 12/18/2006, submitted by Mayor Mallory, recommending the appointment of Dr. Richard M. Ruddy to the Board of Health. Dr. Ruddy is Professor of Clinical Pediatrics for the University of Cincinnati College of Medicine. Dr. Ruddy will fill the vacancy created by the expired term of Ms. Kathleen Clark that expired December 1, 2006. Dr. Ruddy will serve a three-year term that ends on December 31, 2009.

REAPPOINTMENT, dated 12/11/2006, submitted by Mayor Mallory, recommending the re-appointment of Mr. David D. Black to the Citizens Complaint Authority. Mr. Black first joined the Citizens Complaint Authority in June 2005. Mr. Black will serve a two-year term that ends on January 1, 2009.

REAPPOINTMENT, dated 12/11/2006 submitted by Mayor Mallory, recommending the re-appointment of Mr. James J. Carroll to the Lunken Airport Oversight Advisory Board. Mr. Carroll first joined the Lunken Airport Oversight Advisory Board in December 2003. Mr. Carroll is an Attorney at Cors & Bassett. Mr. Carroll will serve a three-year term that ends on September 30, 2009.

REAPPOINTMENT, dated 12/11/2006, submitted by Mayor Mallory, recommending the re-appointment of Mr. Albert F. Peter to the Lunken Airport Oversight Advisory Board. REAPPOINTMENT, dated 12/18/2006, submitted by Mayor Mallory, pursuant to the authority granted by Article V, Section II of the Cincinnati Municipal Code and subject to the consent of Council, I hereby recommend the re-appointment of Mr. Steven Baines to the Cincinnati Board of Health.

REAPPOINTMENT, dated 12/18/2006, submitted by Mayor Mallory, recommending the re-appointment of Ms. Susan Krehbeil Holzapfel to the Lunken Airport Oversight Advisory Board. Ms. Holzapfel first joined the Lunken Airport Oversight Advisory Board in December 2003. Ms. Holzapfel will serve a three-year term that ends on September 30, 2009.

MOTION, dated 12/21/2006 submitted by Mayor Mark Mallory, Councilmembers Berding, Bortz, Cole, Cranley, Crowley, Ghiz, Monzel, Thomas and Vice Mayor Tarbell that the budget presented by Councilmembers Berding, Bortz, Cole, Ghiz and Monzel be adopted with the following changes: Restore $564,940 to the Health Department to the City Manager's original recommendation for a total cut to the Health Department of $2,400,000. Transfer the Office of Environmental Quality from Health into the City Manager's Office. Increase the City Manager's budget by $50,000 to accommodate the transfer of the Office of Environmental Quality. Add $80,000 to Finance for an Internal Auditor. Add $92,500 to the Recreation Commission for a total of $185,000 to maintain the Camp Washington and Carthage Recreation Centers. Add $1,551,653 for HSAC recommendations for a total of $2,200,000 in the General Fund. Add $29,300 to the Mayor's budget to pay for the Sister Cities program and to adjust the Mayor's budget from the 2006 level. Add $155,000 for the Cincinnati Health Relations Commission. Total Increases: $2,523,393. Eliminate vacant positions for an additional savings of $500,000. Eliminate expanded hours for the pools to restore funding to keep all pools open, for a savings of $106,000. Decrease jobs attraction by $750,000. Decrease transfer to capital for demolition of condemned buildings for $449,783. Decrease $100,000 for Gun and Drug Elimination, $132,730 for Findlay Market, and $500,000 for Youth Development in the General Fund and make the corresponding increase in CDBG. Total savings: $2,538,513. Increased revenue identified as a result of the positive variance will be allocated in the following manner: Council will appropriate the first $2,000,000 after the Finance Dept. has certified the end of the year close. The next $2,000,000 will be used to increase the unappropriated surplus. Council will appropriate the next $500,000 after the Finance Dept. has certified the end of the year close. Any additional resources about $4,500,000 will be used to increase the unappropriated surplus. In the capital budget, existing resources will be reprogrammed to allow for the increase in arts facilites and demolition until such time when revenues from the sale of Blue Ash airport can replenish these funds. The administration will present Council with options in January.

ORDINANCE, (EMERGENCY) submitted by Councilmember Berding AUTHORIZING the transfer of the sum of $991,033.81 from the unappropriated surplus of the Citizen Safety Fund 377 to the unappropriated surplus of the General Fund 050 to provide additional resources to the General Fund.

ORDINANCE, (EMERGENCY) submitted by Councilmember Berding, APPROVING and adopting a Capital Improvements Program and Budget for the year 2007, allocating and appropriating taxes and other revenue and existing funds for the purpose of carrying out certain parts of the Capital Improvements Program, and providing for the allocation and appropriation to other parts of said Capital Improvements Program proceeds of the Cincinnati Southern Railway, and authorizing the transfer of money from various existing funds and/or project accounts to various funds and/or project accounts for the purpose of carrying out the Capital Improvements Program.

ORDINANCE, (EMERGENCY) submitted by Councilmember Berding, AUTHORIZING the appropriation to Fund 304, the Community Development Block Grant (CDBG) Fund, the sum of $14,600,000, said amount being part of the 2007 Consolidated Plan Budget to be received from the United States Department of Housing and Urban Development, and further, announcing the City's intention to use said sum for various capital projects and operating allocations in its 2007 CDBG Program.

ORDINANCE, (EMERGENCY) submitted by Councilmember Berding, TO MAKE appropriation of funds from the General Fund for the current expenses and other expenditures of the City of Cincinnati for the fiscal year beginning January 1 and ending December 2007.

ORDINANCE, (EMERGENCY) submitted by Councilmember Berding, TO MAKE an appropriation for the current expenses and other expenditures of the City of Cincinnati from the Water Works Fund, the Parking Facilities Fund, the Convention Center Fund, the General Aviation Fund, the Municipal Golf Fund, the Stormwater Management Fund, the Bond Retirement Fund, the Street Construction, Maintenance, and Repair Fund, the Income Tax-Infrastructure Fund, the Parking Meter Fund, the Municipal Motor Vehicle License Tax Fund, the Sawyer Point Fund, the Recreation Special Activities Fund, the Health Services Fund, and the Cable Communications Fund (hereinafter designated Restricted Revenue Funds) for operating requirements, capital overlay and debt service for the fiscal year beginning January 1, 2007 and ending December 31, 2007.

ORDINANCE, (EMERGENCY) submitted by Councilmember Berding, TO MAKE appropriation for current expenses and other expenditures of the City of Cincinnati from Income Tax-Transit Fund 759 for operating requirements for the calendar year 2007, and further making an appropriation for the current expenses and other expenditures from the Income Tax-Transit Fund for SORTA operations for the period beginning January 1, 2007 and ending March 31, 2007.

RESOLUTION, submitted by Councilmember Berding, EXPRESSING the approval of City Council of the 2007/2008 Biennial Budget for the City of Cincinnati.

ORDINANCE, (EMERGENCY) submitted by Councilmember Bortz, dated 12/20/2006, AUTHORIZING the transfer of the sum of $2,440,000 from various enterprise funds to various Capital Improvement funds and projects, for the purpose of continuing and completing certain capital improvement projects, and authorizing the use and expenditure of $51,775,000 for Cincinnati Water Works Capital Improvements.

ORDINANCE, dated 12/20/2006 submitted by Councilmember Bortz, AUTHORIZING the transfer of the sum of $4,147,600 from the unappropriated surplus of Water Works Fund No. 101 to Water Works Capital Improvement Fund No. 756 and the appropriation therein of said sum for the purpose of continuing funding for the current Capital Improvement Program which includes new water mains, water main replacements, system development, tanks, reservoirs, pumping stations and private development.

ORDINANCE, (EMERGENCY) submitted by Councilmember Bortz, dated 12/20/2006, ESTABLISHING the 2007 New Housing Development Program capital improvement program project account (980x162x03370) within the Department of Community Development, and further transferring the sum of One Million Two Hundred Twenty Five Thousand Dollars ($1,225,000) from the Special Housing Permanent Improvement Fund (761) to the newly established New Housing Development Program capital improvement program project account for the purpose of creating the City's New Housing Development Program for the 2007 as outlined in the Recommended 2007/2008 Capital Budget.

ORDINANCE, (EMERGENCY) submitted by Councilmember Bortz, 12/20/2006, AUTHORIZING the appropriation to Fund 411, the HOME Investment Trust Fund, of the sum of Four Million Two Hundred Seventy-Nine Thousand and Two Hundred Dollars ($4,279,200), said amount being part of the 2007 Consolidated Plan Budget to be received from the United States Department of Housing and Urban Development, and further, announcing the City's intention to use said sum for various capital projects and operating allocations in its 2007 HOME Investment Partnerships Program.

ORDINANCE, submitted by Councilmember Bortz, dated 12/20/2006, AUTHORIZING the City Manager to apply a service charge in the amount of $3.75 per service hour for Cincinnati Police officers' off-duty detail services, for the purpose of offsetting the administrative costs incurred by the Cincinnati Police Department for administering outside detail services to various private entities.

ORDINANCE, submitted by Councilmember Bortz, dated 12/20/2006, REVISING the rates for water service furnished by the Cincinnati Water Works by repealing and reordaining Sections 401-76 (Service Charges), 401-77 (Water Commodity Charges), 401-78 (Charges for Fire Protection Services), and 401-81 (Charges to Political Subdivisions) of Chapter 401 of the Cincinnati Municipal Code.

ORDINANCE, submitted by Councilmember Bortz, dated 12/20/2006, MODIFYING the provisions of Chapter 720, Stormwater Management Code, of the Cincinnati Municipal Code, by amending existing Section 720-59, Monthly Charge Per Equivalent Runoff Unit (ERU).

ORDINANCE, (EMERGENCY) dated 12/20/2006, submitted by Councilmember Thomas, authorizing and directing the City Manager to establish the terms and conditions for the presentation fireworks on Fountain Square from 8:00 a.m. on December 31, 2006 through 8:00 a.m. on January 1, 2007; AUTHORIZING and directing the City Manager to take such actions as are necessary and proper to implement the presentation of such fireworks presentation notwithstanding the provisions of Chapter 713, Section 910-7, Chapter 1213, and any other provisions of the Cincinnati Municipal Code and the Rules and Regulations for the Use of Fountain Square which would prohibit or inhibit programs deemed proper by the City Manager in the presentation of such fireworks.

ORDINANCE (EMERGENCY) submitted by Milton Dohoney, Jr., City Manager, on 12/20/2006, to revise the Classification and Salary Range Schedule for certain employment classifications, by repealing all existing sections of Chapter 307 of the Cincinnati Municipal Code related to compensation schedules for all employees of Division 0 (non-CODE), 5, 8, and 9, and Sections 389 and 365 of of Division 2, and ordaining in their place certain new sections containing compensation schedules for all employees in Divisions 0 (non-CODE), 5, 8, and 9, Sections 389 and 365 of Division 2, of Chapter 307 of the Cincinnati Municipal Code to constitute the new Classification and Salary Range Schedule for said classifications.

ORDINANCE (EMERGENCY) submitted by Milton Dohoney, Jr., City Manager, on 12/20/2006, authorizing the grant of a permanent easement within the Fifth Street right-of-way to Host Cincinnati Hotel, LLC for the encroachment of a public entry revolving door, which interest is not needed for any municipal purpose.

ORDINANCE submitted by Milton Dohoney, Jr., City Manager, on 12/20/2006, approving and authorizing the execution of an Amendment to the Village of Arlington Heights (Arlington) Retail Water Service Contract for the Greater Cincinnati Water Works (GCWW) to provide billing services and to extend the term of the Agreement.

ORDINANCE submitted by Milton Dohoney, Jr., City Manager, on 12/20/2006, authorizing the City Manager to apply for and accept a grant in an amount of up to Ten Thousand and 00/100 Dollars ($10,000.00) from the State of Ohio, Department of Natural Resources' Division of Wildlife, "Hooked on Fishing, Not On Drugs" program, which will provide funding for fishing trips and aquatic educational activities at twenty-six recreation/community centers during 2007, combined with content about environmental conservation and the hazards of using drugs, for children, youth and special population program participants.

MOTION, dated 12/18/2006, submitted by Councilmembers Berding, Cole, Ghiz, Monzel and Bortz, We move that the City Manager's 2007-2008 Biennial Budget be adopted with the following amendments: Operating Budget: Public Safety; Preserve the $1,000,000 in the Clean and Safe Neighborhood Fund to encourage community initiated efforts to improve neighborhood safety, eliminate blight, and increase neighborhood livability. Redirect funding in the amount of $310,000 from the Cincinnati Human Relations Commission to a Youth Violence and Gun Intervention initiative, which will include street workers and monitors, to be administered by the Community Police Partnering Center. An additional $440,000 from the Clean and Safe fund, and an additional $250,000 from private resources will bring the total for Youth Violence Intervention to $1,000,000.
