NOTICE OF A PUBLIC HEARING
BEFORE THE CITY PLANNING COMMISSION
TO EXTEND INTERIM DEVELOPMENT CONTROL OVERLAY DISTRICT NO. 66

On Jan. 25, 2012, City Council established Interim Development Control District No. 66, Broadway Commons District, as an overlay district for a period of ninety (90) days, pursuant to Chapter 1431, Interim Development Control District Regulations, of the Cincinnati Zoning Code.
City Planning Commission gave City Council an affirmative recommendation to establish an IDC Overlay within the half-mile radius surrounding the new casino development, excluding areas east of Interstates 71 and 471 and approved the Broadway Commons District Plan for this area.
The Interim Development Control (IDC) Overlay District has been established in order to allow the Department of City Planning and Buildings to study changes to the existing zoning that will substantially affect the permitted uses within the boundaries of the IDC.
Zoning text amendments are being considered to address uses of property within the IDC District for ONLY the following uses (as such terms are defined in Chapter 1401 of the Cincinnati Zoning Code):
Retail Sales, but only including pawn shops, jewelry, gold and precious metals stores (whether purchasing or selling), video stores, gifts and novelties stores, tobacco stores, liquor and package stores; and
Banks and Financial Institutions, but only including check cashing, currency exchange outlets, and issuers of bail bonds; and
Food Markets, but only including convenience markets; and
Commissaries; and
Personal Services, but only including massage therapy and only to the extent that such massage therapy would require a license under Cincinnati Municipal Code Chapter 897; and
Recreation and Entertainment, but only including bingo parlors and poolrooms; and
Sexually Oriented Businesses.
All other uses and existing uses (that are legally allowable in the underlying zoning districts) are not currently affected by Interim Development Control Overlay District No. 66. The proposed zoning map and zoning text amendments will require significant study and preparation by the City Planning Commission and the City Administration prior to adoption.
The current IDC is imposed for a 90-day period; however, according to Section 1431-09 of the Cincinnati Zoning Code, City Planning must notice the public about the extension of the IDC for an additional nine-month period, which is what the City Planning Commission will act on March 2, 2012.
